About these terms
These terms govern your use of Shopaholics, a collaborative household shopping-list service provided free of charge by Mollo Innovations (Pty) Ltd (registration number 2026/275132/07), trading as Shopaholics ("Shopaholics", "we", "us" or "our"). Our registered address, which is also our address for the service of legal documents, is Regus Business Centre, 1st Floor, Block B, North Park, Black River Park, 2 Fir Street, Observatory, Cape Town, Western Cape, 7925, South Africa. Please read these terms carefully. Your attention is specifically drawn to the clauses in bold below — in particular "Service provided as is", "Limitation of liability" and "Indemnity" — which limit our liability and place certain risks and obligations on you, as contemplated by sections 48 and 49 of the Consumer Protection Act 68 of 2008.
Acceptance
By accessing or using Shopaholics you agree to be bound by these terms, which form a valid and binding agreement concluded electronically. If you do not agree, please do not use the service.
Eligibility
Shopaholics is intended for users who are 18 years or older. If you are under 18, you may use the service only with the consent and supervision of a parent or legal guardian who accepts these terms on your behalf.
Acceptable use
You agree not to use Shopaholics for any unlawful purpose, to upload illegal or harmful content, to spam or harass other users, to attempt to gain unauthorised access to the service or other users' data, or to abuse, overload or disrupt the service. We reserve the right to suspend or terminate accounts that violate these rules.
Your account and household
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account, including the actions of other members within your household. Please notify us promptly if you believe your account has been accessed without your permission.
AI features
Some features (such as recipe import, receipt scanning and voice input) use automated and artificial-intelligence processing. These features may produce results that are incomplete or inaccurate. They are provided for convenience only and are not professional, dietary, financial or nutritional advice — please check any result before you rely on it.
Intellectual property
The Shopaholics application code, design and branding are proprietary and remain our property. All data you create in the service — shopping lists, recipes, meal plans and expenses — remains yours. You grant us a limited licence to host, store and process that content only as needed to provide the service to you and your household. We claim no ownership over your content.
Service provided "as is"
To the maximum extent permitted by law, Shopaholics is provided "as is" and "as available", without warranties of any kind. We do not guarantee that the service will be uninterrupted, error-free, secure, or that any data will be accurate or suitable for a particular purpose. You use the service at your own risk.
Limitation of liability
To the maximum extent permitted by law, Mollo Innovations (Pty) Ltd, its directors and employees will not be liable for any indirect, incidental or consequential loss, or for any loss of data, profits or goodwill, arising out of or in connection with your use of (or inability to use) the service. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited under the Consumer Protection Act 68 of 2008 or other applicable South African law.
Indemnity
You agree to indemnify us against any claim, loss or expense arising from your breach of these terms or your unlawful or improper use of the service, except to the extent that such claim arises from our own negligence or wrongful conduct.
Suspension and termination
You may stop using Shopaholics and delete your account at any time. We may suspend or terminate access where these terms are breached, where required by law, or where necessary to protect the service or its users. On termination, your data is handled in accordance with our Privacy Policy.
Changes
We may update these terms from time to time. We will notify users of material changes by posting a notice in the app. Continued use of Shopaholics after changes are posted constitutes acceptance of the updated terms.
Governing law and jurisdiction
These terms are governed by and construed in accordance with the laws of the Republic of South Africa. You consent to the non-exclusive jurisdiction of the South African courts in respect of any dispute arising out of these terms, and — without affecting your rights under the Consumer Protection Act — you agree that we may institute proceedings in a Magistrate's Court having jurisdiction, even where the amount in dispute would otherwise exceed that court's jurisdiction.
